By clicking the box on the order form and completing a new order with ContentYum, you agree to the following terms and conditions of the Client Agreement:

The project tasks will collectively be hereinafter referred to as “Work”. In this agreement, the Client is referred to as the signer of this agreement.

Payment.  Upon completing and signing this agreement, the client will be redirected to a secure gateway to submit the payment. The client will be billed for any third-party costs incurred by ContentYum at the request of, and with prior written consent (including electronic mail) of, Client.

Permissions and Releases. Client agrees to indemnify and hold ContentYum, its consultants and all other staff harmless against any and all claims, costs, and expenses, including attorney’s fees, due to materials provided by the client and included in the Work at the request of the Client.

Non-Solicitation of Employees. During this engagement period, the Client (signer) shall not directly or indirectly contact, induce or solicit (or assist any Person to contact, induce or solicit) for employment any person who is, or within twelve (12) months prior to the date of such solicitation was, an employee of the ContentYum or any of its Affiliates.

Accreditations/Promotion: ContentYum retains the right to reproduce, publish and display the Deliverables in ContentYum’s portfolios and websites, and in galleries, social media, design periodicals and other media or exhibits for the purposes of recognition of creative excellence or professional advancement, and to be credited with authorship of the Deliverables in connection with such uses. Either party, subject to the other’s reasonable approval, may describe its role in relation to the Project and, if applicable, the services provided to the other party on its website and in other promotional materials. 

Miscellaneous. A waiver of a breach of any of the provisions of this Agreement shall not be construed as a continuing waiver of other breaches of the same or other provisions.

Cancellation.  The payment is collected in full prior to start of work. No Refunds will be issued. If this is a month-to-month service, the Client must provide 30-day notice of cancellation.
